Terms of Use
1. Eligibility
You must be at least 18 years old to use NightIn. By registering, you represent that you meet this requirement.
Where we offer verified ID or similar checks, you agree to provide accurate information and to complete verification when required. We may suspend or refuse access if verification fails or if we reasonably believe your information is false or misleading.
2. Your account
You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activity under your account, unless you notify us promptly of unauthorized use.
- Keeping your profile information accurate and up to date.
You may not share your account with others, create multiple accounts to evade restrictions or enforcement, or use another person’s identity without permission.
3. Content and conduct
You retain ownership of content you post, but you grant NightIn a license to host, display, and distribute that content as reasonably necessary to operate the Service (including showing your profile and event details to other users).
You agree not to use NightIn for illegal activity, harassment, hate speech, non-consensual intimate imagery, sale of illegal goods, or any purpose that violates applicable law.
You agree to respect hosts and guests: communicate honestly, honor boundaries, and follow event-specific rules communicated by hosts.
4. Hosting events
If you host through NightIn, you agree to:
- Provide accurate descriptions of your event, timing, location (as disclosed through the Service), capacity, and any costs or contributions.
- Maintain a safe and lawful environment to the best of your ability, comply with local laws and lease or building rules, and not mislead guests about risks or conditions.
- Use guest information only for organizing and hosting the event, not for unrelated marketing or resale of contact data.
You are responsible for your home, your guests’ conduct to the extent reasonable, and compliance with alcohol, noise, and other local regulations. NightIn does not inspect venues or guarantee suitability.
5. Attending as a guest
As a guest, you agree to:
- Read and follow the host’s house rules and event description.
- Show up when you have committed to attend, or cancel in a timely way through the Service when possible so another guest may take your place.
- Treat the host’s space and other attendees with respect; leave when asked; and not record or share others’ personal information without consent where such recording would be inappropriate.
6. Vouch system
Where NightIn includes a vouch or reputation feature, vouches reflect other users’ subjective experiences. You agree to:
- Vouch honestly and only for people you have genuinely met through good-faith participation in the community.
- Not trade, sell, or coerce vouches, or use alternate accounts to manipulate reputation.
We may remove or adjust vouches that appear fraudulent or abusive.
7. Free tier limits
Unless you are on a paid or promotional plan that says otherwise, the free tier may include limits such as: one hosted event and one attended event per calendar month (or as displayed in the product at the time you use it). Limits apply per account and may change with notice where we are required to provide it.
Attempting to circumvent limits (for example, through multiple accounts) is a breach of these Terms.
8. Prohibited conduct
In addition to rules above, you must not:
- Scrape, overload, or interfere with the Service or other users’ access.
- Reverse engineer or attempt to extract source code except where law permits.
- Upload malware or misuse reports or support channels.
- Use NightIn to arrange commercial sex work, human trafficking, or exploitation of any kind.
- Discriminate unlawfully in selecting guests or hosts where applicable law applies.
9. NightIn is a platform
NightIn provides software and introductions. We do not employ hosts, control private homes, or supervise events in person. We are not responsible for the conduct of users, the quality or safety of events, food or drink, travel, or any dispute between you and another person.
To the fullest extent permitted by law, the Service is provided “as is” without warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant uninterrupted or error-free operation.
10. Limitation of liability
To the fullest extent permitted by applicable law, NightIn and its affiliates, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service or attendance at events.
Our aggregate liability for claims relating to the Service is limited to the greater of one hundred U.S. dollars (USD $100) or the amounts you paid to NightIn for the Service in the twelve months before the claim (if any). Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.
You use NightIn and attend events at your own risk. Use good judgment, meet in safe settings, and follow public health and safety guidance.
11. Indemnity
You agree to defend and indemnify NightIn (and its affiliates and personnel) against claims, damages, and expenses (including reasonable attorneys’ fees) arising from your content, your events, your attendance, or your breach of these Terms, except to the extent caused by our gross negligence or willful misconduct.
12. Termination
You may stop using NightIn at any time and may request account deletion subject to our Privacy Policy.
We may suspend or terminate your access if you violate these Terms, create risk or legal exposure, or if we discontinue the Service (or a portion of it). Provisions that by their nature should survive (including liability limits, indemnity, and dispute terms) will survive termination.
13. Changes
We may modify these Terms. We will post the updated Terms and update the “Last updated” date. If changes are material, we will provide notice as required by law or as we reasonably deem appropriate. Continued use after changes become effective constitutes acceptance unless law requires otherwise.
14. General
These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules, unless your jurisdiction mandates otherwise. Courts in that jurisdiction (unless prohibited) have exclusive venue for disputes, except that either party may seek injunctive relief in any court of competent jurisdiction.
If a provision is unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver.
